All Gary Pools warranties are those of the respective Manufacturers.
Gary Pools warrants no products. All suspected warranty problems are to be reported to the manufacturer at once. Any manufacturers warranty may be viewed by the customer Prior to purchase.
Gary warrants all labor work on performed by itself for a period of thirty (30) days. The labor must be written on a formal invoice or service work sheet. Independent contractors or unauthorized labor is NOT warranted at all.
All labor under warranty (ex.-filters, motors) is performed in-house only.
Gary Pools does not employ on the road service crews. All parts and
labor warranted for thirty (30) days. Any and all transportation (including shipping) costs to and from the designated Gary Pools service area(s) are the responsibility of the customer, not Gary Pools.
If merchandise is returned with the receipt, within fourteen (14) days of purchase, unused, in its original packaging, and can be put back into inventory and sold at its full retail price, a full refund will be issued to the customer in the form of cash or credits in event of the original purchase being Master Card, Visa, Discover, or Financing. A maximum of $50.00 is allowed via store cash register. Any refund greater that $50.00 must be by check issued by the Union Rd. location and May take 7-10 days waiting period for the check to be processed. Proof of purchase must be present and surrendered if any return for refund is made. All used or unopened merchandise which is not defective will be subject to a 20% restocking fee. Absolutely, no returns after 30 days due to the seasonality of our products.
All suspected defective merchandise is to be returned to any Gary Pools, 2275 Union Rd., Cheektowaga, NY 14227 for inspection by management. If the merchandise is found to be defective and not broken due to misuse or negligence, it will be replaced by identical merchandise or equal value as per the terms of the manufacturer’s warranty within 1 Year of receipt. This in-house warranty replacement is provided as a courtesy of Gary Pools through the cooperation of our respective manufacturers. If there is no formal warranty covering the merchandise and the merchandise is brought back to us within thirty (30) days of purchase, the merchandise will be inspected by Gary Pools management, and if found to be defective will be replaced for the same product at the discretion of the management. Gary Pools does not warranty any product.
Any time display or sample merchandise is sold, it is understood by the Buyer that the priced marked is specially priced as a “Final Sale” and the merchandise are being bought in an “As Is” condition. Unless specifically noted on the sales slip, there is no warranty on the merchandise.
OUT OF STOCK ITEMS
Generally if an item(s) becomes unavailable for immediate shipping, it will not be made available for purchase on the internet. Sometimes items become "Out of Stock" prior to inventory updates and we are unable to process your order. When this happens we will contact you with other options, but we will not process any orders on your credit card until you have confirmed that you want us to proceed with any other options offered to you. We do apologize for this inconvenience.

Despite our efforts, there may be instances when information about a Product contains inaccurate or incomplete data, including data about the Product's price or availability. Gary Pools makes no warranty or guarantee that the information on GaryPools.net is error-free, complete, or current. We reserve the right to correct errors and/or update the content on Garypools.net at any time without notice. Gary Pools also reserves the right to refuse or cancel any order containing any error or inaccuracy, including after the order has been submitted, whether or not the order has been confirmed and your credit card charged. If your order is canceled after your payment has been processed, we will issue a full refund to the original pay type.
Availability of Colors/Styles
Gary Pools reserves the right to substitute products of the the same make/model with different color/style options if a product is ordered and no longer available. e.i. Floating Lounge which can be ordered in Blue, Pink or Yellow. Blue is no longer available for that lounge so Gary Pools will substitute with either Pink or Yellow. This insures you receive the product in a timely fashion and there is not any delays to your order. If you choose a color/style and do not want a substitute you will need to state that at the time of your order and the item will be canceled from your order prior to processing.
